Terms of Use

These Terms of Use (“Terms”) are an agreement between you and Fissible LLC (“Fissible,” “we,” “us,” or “our”) governing your use of Fissible Phone (the “App”) and fissiblephone.com (the “Site”), together the “Service.” By downloading, installing, or using the App, or by using the Site, you agree to these Terms. If you do not agree, do not use the Service.

The Service

Fissible Phone is an iOS business phone app for owners and small teams. During early access, the App connects to your own Twilio account and, optionally, your own AI provider key. Fissible is not a telecommunications carrier and does not operate the call infrastructure your business line runs on — your Twilio account does.

Eligibility and your account

You must be able to form a binding contract to use the Service, and you must be using the App for a legitimate business or professional purpose. You are responsible for maintaining the confidentiality of any credentials used to access the App, and for all activity that occurs through your use of the Service.

Your Twilio account and other third-party services

You are responsible for creating, funding, and maintaining your own Twilio account, and for complying with Twilio’s terms of service and acceptable use policies. If you configure an AI provider for voicemail analysis, you are responsible for that provider’s terms and costs as well. Fissible does not control, and is not responsible for, the availability, performance, pricing, or policies of Twilio or any AI provider you choose. Fissible Phone uses Twilio-powered communication infrastructure and is not affiliated with, sponsored by, or endorsed by Twilio.

Subscriptions

Some features of the App are offered as auto-renewing subscriptions purchased through the Apple App Store, as described on our Pricing page. Prices shown on the Site before the App is generally available are for planning purposes and are subject to change.

When a subscription is available for purchase, the following applies:

• Payment will be charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew for the same duration and at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period, and the cost of the renewal will be identified.
• You can manage or cancel a subscription any time after purchase by going to your Apple ID Account Settings; canceling stops future charges but does not refund the current period.
• If a free trial is offered, any unused portion is forfeited when you purchase a subscription during the trial period, where applicable.

On Receptionist-tier plans, included call minutes reset each billing period and do not roll over. Additional minute packs, where offered, are billed separately at the time of purchase.

Done-for-you services

Guided setup, A2P 10DLC registration, the setup bundle, and compliance maintenance (described on our Pricing page) are human services performed by Fissible outside the App and billed separately from any App Store subscription. Ongoing carrier or registry fees charged by Twilio bill directly to your own Twilio account and are not part of the fee you pay Fissible for these services.

Acceptable use

You agree not to use the Service to violate any law, to place calls or messages you do not have the right to send, to abuse, harass, or defraud any person, to interfere with the Service’s operation or security, or to circumvent any usage limits associated with your plan.

Intellectual property

Fissible and its licensors own the App, the Site, and all related content, features, and trademarks, excluding any content that belongs to you or to third parties like Twilio. We grant you a limited, revocable, non-exclusive license to use the App on Apple-branded devices you own or control, for your own business purposes, subject to the App Store’s Usage Rules and these Terms.

Disclaimers

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, Fissible disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service, or the third-party Twilio and AI infrastructure it depends on, will be uninterrupted, error-free, or free of missed or dropped calls.

Limitation of liability

To the maximum extent permitted by law, Fissible will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising from your use of the Service, even if advised of the possibility of such damages. Fissible’s total liability for any claim arising from the Service will not exceed the amount you paid Fissible for the Service in the twelve months before the claim arose.

Indemnification

You agree to indemnify and hold Fissible harmless from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party, including Twilio or any caller you interact with through the App.

Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service if you violate these Terms or if we discontinue the Service, though we will not do so to route around a fee you have already paid to us without providing what that fee was for.

Apple App Store terms

These additional terms apply if you obtained the App from the Apple App Store, and are between you and Fissible, not Apple:

• This license is limited to a non-transferable license to use the App on any Apple-branded product you own or control, as permitted by the App Store’s Usage Rules.
• Apple has no obligation to furnish maintenance or support for the App; that responsibility belongs to Fissible, as described in these Terms.
• In the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the App; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Fissible, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your possession or use of it, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
• In the event of a third-party claim that the App infringes that party’s intellectual property rights, Fissible, not Apple, is responsible for the investigation, defense, settlement, and discharge of that claim.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with any applicable third-party agreement (for example, your wireless data service agreement) when using the App.
• Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.

Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be brought in the state or federal courts located in Sacramento County, California, and you consent to jurisdiction there.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Continued use of the Service after changes take effect means you accept the updated Terms.
